Website Terms & Conditions

1. Who we are
These Terms & Conditions (Terms) apply to your access to and use of the website, client portal and any related apps, tools or services (collectively, Platform) operated by Finance Innovations Pty Ltd (ACN 670 306 135) as Corporate Authorised Representative of AFSL 468166 (referred to as Advanced, we, our or us).
By accessing or using the Platform you agree to these Terms, our Privacy Policy and any other policies or notices we publish on the Platform. If you are using the Platform on behalf of an entity, you represent that you are authorised to bind that entity to these Terms. If you do not agree, do not use the Platform.
2. What we do (and don’t do)
2.1 R&D finance & related services. We operate a commercial lending and platform service focused on R&D tax incentive (RDTI) financing and related products. Any facility, loan, line of credit or other finance is subject to separate, binding legal documentation (e.g. a facility agreement) and our credit assessment.
2.2 General information only. Content on the Platform is general information. It is not personal advice, legal advice, tax advice or a recommendation. Consider your circumstances and obtain professional advice.
2.3 Licensing. We act as a Corporate Authorised Representative of AFSL 468166 for activities that are financial services. Credit activities are provided in accordance with applicable law and may not be regulated by the AFSL regime.
2.4 Eligibility. Our services are intended for businesses and their authorised representatives. The Platform is not for personal, household or domestic purposes.
3. Accounts and users
3.1 User types.
- Applicants – companies and authorised representatives submitting finance enquiries or applications.
- Advisers/Referrers – R&D advisers, accountants or partners who assist Applicants or introduce opportunities.
- Visitors – anyone browsing the site without registering.
3.2 Registration & security. You must provide accurate, current information and keep it updated. Keep your login secure and tell us immediately if you suspect unauthorised access. You are responsible for all activity under your account.
3.3 Age & authority. You warrant you are at least 18 and have authority to bind the organisation you represent.
4. Application data, consents and checks
4.1 Your information. You agree that information you provide is true, complete and not misleading.
4.2 Consents. You authorise us (and our service providers) to collect, use and verify information for identity (KYC), anti-money laundering (AML/CTF), sanctions screening, fraud prevention, credit and risk assessment, and servicing. This may include information from government registers (e.g. ABN/ASIC/ATO), bank feeds/open banking providers, accounting systems (e.g. Xero), payroll/ERP, trade references and credit reporting bodies, subject to applicable law and our Privacy Policy.
4.3 Verification. We may require documents or access (for example, identity documents, financial statements, R&D registration evidence, ATO activity statements and RDTI records) to assess eligibility. If you do not provide requested information, we may be unable to proceed.
5. Use of the Platform
5.1 Licence. We grant you a personal, revocable, non-exclusive, non-transferable licence to access and use the Platform in accordance with these Terms.
5.2 Acceptable use. You must not: (a) breach any law; (b) infringe IP or privacy rights; (c) upload malware or harmful code; (d) scrape, crawl or mine data (except as permitted by applicable law and our robots.txt); (e) bypass security; (f) copy, modify, reverse engineer or create derivative works of the Platform; (g) use the Platform to post unlawful, defamatory, misleading, offensive or confidential third-party information; or (h) use the Platform to offer, promote or solicit products/services unrelated to an application with us.
5.3 Availability. We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. We may change, suspend or withdraw any part of the Platform at any time.
6. Content, confidentiality and IP
6.1 Your content. You retain ownership of documents and data you upload. You grant us a worldwide, royalty-free licence to host, use and process that content solely to operate the Platform, assess applications, manage facilities and comply with law.
6.2 Confidentiality. We will treat non-public application information as confidential and handle personal information in line with our Privacy Policy. You must keep any non-public information you access via the Platform (including draft terms, pricing or counterparties) confidential.
6.3 Our IP. We (or our licensors) own the Platform and all associated intellectual property. Nothing transfers ownership to you. Do not use our trade marks, branding or materials without our written consent.
7. Third-party services
The Platform may integrate with or link to third-party services (e.g. identity verification, open banking, cloud hosting, e-signature, analytics, communication tools and payment processors). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party content or services.
8. Fees and product terms
Platform access is generally free. Any application fees, establishment fees, interest, charges or break fees are set out in facility-specific documentation or disclosures and may change prior to execution. Indicative quotes shown on the Platform are illustrative only and non-binding until formal offer and contract.
9. Privacy
We handle personal information in accordance with our Privacy Policy (available on the Platform). By using the Platform, you consent to our privacy practices, cookies and analytics as described there. You may opt out of direct marketing as set out in the Privacy Policy.
10. Disclaimers
10.1 General. The Platform and its content are provided “as is” and “as available.” To the extent permitted by law, we make no warranties of accuracy, completeness, fitness for purpose, availability, merchantability or non-infringement.
10.2 No guarantee of approval. Submitting information does not guarantee eligibility, approval, pricing, timing or funding. Decisions are made at our discretion and subject to separate contracts and conditions precedent.
10.3 ACL protections. Nothing in these Terms excludes, restricts or modifies any non-excludable rights under the Australian Consumer Law. If we are liable for breach of a consumer guarantee and the services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited (at our option) to resupplying the services or paying the cost of resupply.
11. Liability cap
To the maximum extent permitted by law, we and our related parties are not liable for any indirect, consequential, special or incidental loss, loss of profit, revenue, data, goodwill or business interruption arising from or in connection with the Platform. To the extent we have liability that cannot be excluded, our aggregate liability to you for all claims arising out of or in connection with the Platform is limited to AUD $100.
12. Indemnity
You indemnify us and our related parties from and against losses, costs, claims and expenses (including reasonable legal costs) arising from: (a) your breach of these Terms; (b) your misuse of the Platform; (c) your content (including IP or privacy claims); or (d) your unlawful acts or omissions.
13. Suspension and termination
We may suspend or terminate your access immediately if we reasonably believe you have breached these Terms, threatened the security or integrity of the Platform, or where required by law/regulators. You may close your account at any time. Sections intended to survive (including 6, 8–15) survive termination.
14. Electronic communications and signatures
You consent to receive communications electronically (including notices, disclosures and documents) and to transact using electronic signatures via the Platform or our e-signature provider, to the extent permitted by law.
15. Changes to these Terms
We may update these Terms at any time by posting the revised version on the Platform. Changes take effect when posted (unless a later date is stated). Your continued use constitutes acceptance of the updated Terms.

If required by law (for example, where you are a “retail client” for a financial service), we will provide details of our internal dispute resolution process and any applicable external dispute resolution scheme.
17. General
17.1 Governing law. These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.
17.2 Severability. If any part of these Terms is invalid or unenforceable, the remainder remains effective.
17.3 No waiver. A failure to exercise or delay in exercising a right is not a waiver.
17.4 Assignment. We may assign or novate our rights or obligations at any time. You must not assign your rights without our prior written consent.
17.5 Entire agreement. These Terms, together with the Privacy Policy and any product-specific terms, are the entire agreement between you and us for your use of the Platform.

1. Who we are
This Privacy Policy applies to Finance Innovations Pty Ltd (ACN 670 306 135) as Corporate Authorised Representative of AFSL 468166 (referred to as Advanced, we, our, or us) in relation to our operations in Australia. It explains how we manage personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

By using our website, products or services, you agree to this policy. We may update it from time to time; changes apply prospectively and will be posted on our website.
2. The information we collect
Subject to law and the APPs, we may collect:
- Identity & contact: name, date of birth, addresses, email, phone.
- KYC/AML: driver licence, passport or other ID details; beneficial ownership information; company/director details; sanctions screening results.
- Financial: bank account details, funding application data, income/expenses, transaction history, security/collateral information.
- Business information: ABN/ACN, company structure, shareholdings, cap tables, director/secretary details.
- Regulatory identifiers: TFN information (handled in line with the Privacy (Tax File Number) Rule 2015).
- Technical: IP address, device/browser type, pages viewed, cookies, analytics and log data.
- Communications: enquiries, feedback, survey responses, support tickets.
- Public/third-party sources: regulators, credit or identity verification providers, your advisers, and publicly available records.
We generally collect personal information directly from you, but may also collect it from your authorised representatives, service providers (e.g. identity verification), public sources and government registers where lawful.
3. Why we collect and how we use information
We use personal information to:
- verify identity and meet AML/CTF and other legal obligations;
- assess, originate and manage applications, facilities and transactions;
- operate, maintain and improve our website, products and services;
- provide customer support and respond to enquiries;
- personalise content and measure service performance;
- conduct research, analytics and reporting (including de-identified/aggregated data);
- send service communications and (where permitted) direct marketing;
- manage fraud prevention, security and risk;
- comply with laws, regulatory reporting and requests from authorities.

4. Cookies, analytics and remarketing
We use cookies and similar technologies to operate our site, remember preferences and understand usage. We use Google Analytics and may enable Google Advertising features (e.g. remarketing). These services collect aggregated traffic data; they do not identify you to us. You can manage cookies in your browser settings and use Google’s available opt-out tools. Our site may include social media interfaces (e.g. LinkedIn); if you interact, those platforms may associate your visit with your account per their policies.
5. Disclosing your information
We may disclose personal information to:
- our related entities and personnel;
- service providers and partners who help deliver identity verification, hosting, cloud/storage, analytics, communications, payment processing, professional, audit and compliance services;
- your authorised representatives and advisers;
- financiers, insurers, brokers and agents involved in your facility (where applicable);
- regulators, law enforcement and government agencies as required or authorised by law;
- prospective purchasers or transferees in connection with a business restructure or transaction (subject to confidentiality).
We may share de-identified or aggregated insights for research, benchmarking or reporting. We do not sell personal information.
6. Overseas disclosures
Some recipients (e.g. cloud, support or verification providers) may be located outside Australia. Locations vary over time depending on suppliers and may include (for example) the United States, the European Union, the United Kingdom and parts of the Asia-Pacific. We take reasonable steps to ensure overseas recipients will protect personal information in a way that is substantially similar to the APPs. Contact us if you would like to know current countries of disclosure.
7. Credit-related information (if applicable)
If, in assessing or managing a facility, we handle credit-related information, we will do so in accordance with the Privacy Act (Part IIIA) and the Credit Reporting Privacy Code. This may include obtaining and using credit eligibility information from credit reporting bodies and exchanging information with your referees or advisers where you authorise. On request, we will provide further details of our credit information handling practices.
8. Data security
We use administrative, technical and physical safeguards designed to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Where we provide account access, you are responsible for keeping credentials secure. No internet transmission is entirely secure; any transmission is at your own risk. If a data breach is likely to result in serious harm, we will assess and, where required, notify you and the OAIC under the Notifiable Data Breaches scheme.
9. Retention
We keep personal information only for as long as needed for the purposes outlined or to comply with legal, tax and regulatory requirements (for example, certain AML/CTF and financial records are typically retained for at least 7 years). We then destroy or de-identify information where lawful and practicable.
10. Access and correction
You may request access to, or correction of, your personal information. We may need to verify your identity and, in limited cases, charge a reasonable administrative fee. We will respond within a reasonable period and provide reasons if we cannot give access or make a correction (you may request that a statement be associated with the information).

- Cookies/analytics: adjust your browser settings and use available opt-out tools.
- Withdrawing consent: where processing relies on consent, you may withdraw it (this will not affect prior lawful processing).
12. Third-party links
Our website may link to third-party sites. Their privacy practices are their own; we recommend reviewing their privacy policies before providing personal information.
13. Children
Our services are intended for business and adult users. We do not knowingly collect personal information from children.

Availability, security and viruses
We aim for the Platform to be available, secure and up-to-date, but we do not warrant it will be uninterrupted, error-free or free from harmful code. You are responsible for implementing appropriate safeguards (e.g. up-to-date antivirus, backups).
Liability

Permitted use
You may view the website and, for personal or internal business purposes only, temporarily cache and print reasonable extracts unaltered and with attribution to Advanced. Any other use requires our prior written consent.
Prohibited use
Except as expressly permitted by applicable copyright law or our written consent, you must not:

User materials
If you upload or submit materials to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to host and use those materials solely to operate the Platform, assess applications, manage facilities and comply with law. You must have all necessary rights to upload such materials.

Take-down
